1. Versa Cocktails Pty Ltd is committed to respecting the privacy of your personal information. This Privacy Policy explains how we deal with your personal information that we collect, use, disclose or process.
2. We will update this Privacy Policy from time to time when we change how we deal with personal information. We will post any changes to the Privacy Policy on our website, and will endeavour to notify you when this occurs.
3. In addition to the provisions of this Privacy Policy, there may also be specific and additional privacy and consent provisions that apply to certain collection channels of personal information. Because those specific and additional provisions also relate to your privacy protection, we recommend that you review them wherever they appear. In the event of any inconsistency between the provisions of this Privacy Policy and those other specific and additional provisions, the specific and additional provisions will prevail.

Definition of personal information

1. Throughout this Privacy Policy, we use the term ‘personal information’ to refer to information relating to an identified or identifiable natural person, including information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not; and whether the information or opinion is recorded in a material form or not. For example, your full name, date of birth, address, mobile telephone number, email address and credit card details are examples of information which may constitute personal information. Personal information may also include information we may collect about your individual preferences.

Problems, complaints or queries

Please allow 30 days for this request to be processed. On receipt of your query, problem or complaint a review will be conducted and findings will be communicated to you where required. If you do not receive a satisfactory response to your query, problem or complaint within 30 days, you may refer your query, problem or complaint to the Office of the Australian Information Commissioner via the contact details listed at www.oaic.gov.au/about-us/contact-us-page, or, for individuals in the EU, to the data protection supervisory authority in your country.

Lawful basis of processing

1. Versa Cocktails will only collect, monitor, use, disclose, or process any personal information about you with your consent (which we endeavour to obtain at the same time as collecting your personal information) or if it is otherwise lawful to do so. The only personal information collected by us is what has been provided to or collected by us in accordance with this Privacy Policy or has been provided to us lawfully by third parties. We will generally deal with your personal information for the primary purposes set out in this Privacy Policy.
   
   

Active Information Collection

1. Personal information may be collected and combined via our Collection Channels if you:
   1. you purchase products either as a “guest” or a “member” through a Collection Channel, or create an account with Versa Cocktails through a Collection Channel;
   2. subscribe to any newsletters, updates, alerts or news and media releases, or request launch or event information or information about our products or services or other information services as well as third party products or services;
   3. have previously provided us with personal information prior to this Privacy Policy coming into effect, either directly from you personally or via a third party;
   4. complete and submit any forms or surveys provided to Versa Cocktails, either physically or electronically;
   5. conspicuously publish or provide on request your personal information to Versa Cocktails;
   6. contact us or our clients directly in person or via any medium including mail, telephone, social media and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) including via the contact details listed on a Website;
   7. participate in any events, offers, promotions, competitions or marketing activities;
   8. interact with a Website for a specific purpose; or
   9. interact with or browse a Website generally.
      
      
2. We also collect your information through other legitimate third party sources including list brokers, social media organisations, and other data providers or organisations that share data in circumstances where it is lawful and/or you have given permission for them to do so.

1. We may collect personal information including:
   1. your full name, contact details (such as your email address, phone number, and contact preferences), location, and passwords you create for the Versa Cocktails website;
   2. information about your preferences, interests, opinions, feedback and experiences with our products or services. This information is collected in order to tailor our communications to you and continuously improve our products and services;
   3. financial details, if you have provided them to us, such as your bank account, credit card, Paypal or other online payment system details (where you purchase any products or services from us);
   4. When you visit the Versa Cocktails website, we may also collect personal information about you in the following general categories:
      1. usage and preference information: we collect information about how you interact with the  website, including the pages you visit, your preferences and settings that you choose. We may do this through the use of cookies and other similar technologies that uniquely identify you;
      2. device information: we may collect information about your mobile device such as the hardware model, operating system, preferred language, unique device identifier and mobile network; and

• other information: we may also collect and log information such as your IP address, access dates and times, browser type and pages visited when you interact with a website.

1. any other personal information you provide directly to us. Where you provide us with unsolicited personal information, we will retain this information where it falls within our primary purposes for collection of personal information (as stated in this Privacy Policy).
2. any other personal information requested or required by a Collection Channel.

Sensitive Information

1. We do not seek to collect sensitive information (or “special categories” of information under the GDPR).
2. If we do collect sensitive information, Versa Cocktails we will only do so with your consent and where you provide it to us directly. Where you provide us with any sensitive information (including, but not limited to, information about your sexual orientation, religious beliefs, medical and/or criminal history), we will only use this information for the purposes stated at the time of collection and will only share this information with our trusted third parties in the manner stated in this Privacy Policy.

Consequences of not providing personal information

17. If you don’t provide us with personal information, we may be unable to provide you with our goods and services or other content, information, upcoming opportunity, promotion, event or product information.

 

Terms and Conditions - IXL Appliances x Versa Instagram Competition

 

1. Information on how to enter and prizes form part of these terms and conditions. Entry into this competition is deemed to be acceptance of these terms and conditions.
2. The competition (“Competition”) is open to residents of Australia only, who are 18 years of age or older as of the beginning of the Competition period, and who are not an employee of or domiciled with an employee of the Promoters or any of their affiliated companies.
3. The hosts (“Promoters”) of this competition are IXL 25123411 and Versa Cocktails ABN 68 642 820 942.
4. This Competition commences on 05 September 2021 at 12:00pm AEDT and ends on 15 September 2021 at 11:59pm AEDT (“Competition Period”).
5. To enter the Competition, entrants must follow and like a photo on the Instagram account via feed or stories and tag both @versa_cocktails and @ixlappliances in this post (on Instagram) during the Competition Period. This contest is not sponsored, endorsed or administered by, or associated with Instagram. Entrants can enter multiple times to increase their likelihood of winning. The Promoters take no responsibility for any entries that are late, lost, misdirected or not received by the Promoters within the competition period. All entries become the property of the Promoters.
6. The Promoters will select one valid entry at random as the winner. The draw will take place at 09:00am on 16 September 2021. The winner will be notified via Instagram or email (using account / address registered with the Promoters) on or around the same date. The winners name will be published on the Promoters website.
7. The Promoters decision is final and no further correspondence will be entered into.
8. There is one prize to be won. The prize is 1x IXL fire pit AUD$549 and 4x 700ml bottle of Versa Negroni to the value of AUD$300 (“The Prize”).
9. The Prize must be accepted as awarded and is not transferrable or redeemable for cash. Any unused portions or elements of the Prize are forfeited.
10. The total prize pool value is AUD$849. The promoters accept no responsibility for any variations in the Prize value. If any elements of the prize are not available due to unforeseen circumstances, the Promoters may provide a substitute prize for equal or greater value. The Prize will be distributed or collection will be arrange for the Winner within 1 month after the acceptance of the Prize / Prize draw date.
11. If the Winner is not a resident of Victoria and is required to travel to receive the Prize, any costs associated with this travel are the responsibility of the Winner. If there are any travel restrictions in place at the time of booking, the Promoters take no responsibility for any loss or damages. If the winner is required to cancel elements of the Prize, and these cannot be rescheduled, the Winner is forfeiting their right to the Prize.
12. If the Prize is unclaimed by 10.00am AEDT on 30 september 2021, a further draw will take place to select a replacement winner. The replacement winner will be notified by email on or around that date. The replacement winner must claim the Prize by responding to the Promoter via email by 10:00am AEST 1 April 2021. The winner’s name will also be announced on the promoters websites on or around 30 september 2021.
13. This promotion may be promoted through third party websites, such as Facebook or Instagram. Entrants must at all times comply with the terms of service for those third-party websites when using them to participate in this Promotion.
14. The use of pen names, or any robotic, automatic, programmed or any other entry methods not authorized by these terms and conditions is not permitted. Entries that are incomplete, illegible, damaged, contain incorrect information or do not comply with these terms and conditions will be disqualified. Entrants who provide incorrect, incomplete, incomprehensible or fraudulent information or whom do not comply with any of these terms and conditions are not eligible to participate in this Competition.  The Promoter reserves the right to request, appropriate photo identification to confirm entrants’ eligibility to enter this Competition and claim a prize, before issuing a prize and may deem the entry invalid.
15. The Promoters and its associated agencies and companies and third-party websites specified in clause 13 are not liable for any problems or technical failure including any internet, telecommunication or website technical problems or any damage to computers in relation to this Competition. If for any reason this Competition is not capable of running as planned due to any technical problems the Promoter reserves the right in its sole discretion to cancel, postpone, or amend this Competition (subject to any directions issued by a regulatory authority).
16. The Promoters as well as its associated agencies and companies and third-party websites specified in clause 13 are not liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with the Prize or use of the Prize. This excludes any liability that cannot be excluded by law (in which case that liability is limited to the minimum permitted by law). To the maximum extent permitted by the law, entrants release the Promoter and its associated agencies, companies and Facebook and Instagram from any and all claims that may arise in connection with this Competition.
17. If any of these terms and conditions is held to be invalid or unenforceable in whole or in part, that part shall be severed from the remainder of the provisions and the validity of the other provisions and the remainder of the provision in question shall not be affected.
18. The Promoter collects entrants' personal information in order to conduct the Competition. If the information requested is not provided, the entrant may not participate in the Competition. By entering the Competition, unless otherwise advised, each entrant also agrees that the Promoter may use this information and approved images (photograph and/or film recording) or discloses it to other organizations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant. By subscribing to receive the Promoter’s marketing communications and entering this Competition entrants consent to the Promotor collecting their personal information in accordance with the Promoter’s privacy policy, a copy of which is available at the Versa Cocktails Website.
